Hello, and welcome to Jack Fertility's Terms of Service. We know this isn't the most exciting read, but it's important — these terms explain how our service works, what you can expect from us, and what we ask of you in return.

Our aim is to be clear, fair, and upfront. If something ever goes wrong, we'll do our best to put it right.

⚠️ Important note

Jack Fertility's service is for people with sperm who want to learn more about their reproductive health. It is intended solely for wellness purposes, not for clinical diagnosis. Test results are provided for information only and should not replace advice from a healthcare professional. Due to natural variations in semen parameters, results from Jack Fertility may differ from semen analysis results you have received in the past, or may receive in the future.

Our testing kits are registered general IVD medical devices, regulated under the UK Medical Devices Regulations 2002 and registered with the MHRA. Each kit is supplied with Instructions for Use (IFU). You must read and follow the IFU carefully — failure to do so may affect the accuracy of your results.

Who can use Jack Fertility?

  • You must be 18 or older and legally able to consent to our services.
  • You must be based in the UK. We do not accept non-UK orders.
  • By ordering, you confirm the information and samples you provide are genuinely yours and given with your consent.

Your account

Keeping it secure: If you create an account with us, you are responsible for keeping your login details safe. Please let us know straight away if you suspect someone else has accessed your account without permission.

Updating details: Keep your account details accurate and up to date so we can provide the best service.

Access and deletion: You can request a copy of the information linked to your account, or ask us to delete your account, at any time by contacting us at privacy@jackfertility.co.uk. If you close your account, we will delete or anonymise your personal data unless we are required to keep it for legal, regulatory, or safety reasons. See our Privacy Policy for full details.

Our rights: We may suspend or close accounts if they are misused, if knowingly false or misleading information is provided, or if these Terms are breached. We will always act reasonably and, where possible, let you know the reason.

Using our website

  • You can use our website for personal, non-commercial purposes only.
  • Do not misuse it — that means no hacking, scraping, or interfering with how the site works.
  • The content we provide is for general information only and does not replace medical advice.

Signing up for newsletters or promotions

If you sign up for newsletters, promotions, or waitlists, you agree to receive the messages you have opted in to. You can unsubscribe at any time using the link in our emails or by contacting us directly. For details on how we use your information, please see our Privacy Policy.

How to place an order

  • Orders are placed through our website.
  • Payment is taken at the time of order. We use secure third-party payment providers.
  • We may reject or cancel an order if you are outside the UK, payment cannot be processed, or we believe the order is fraudulent or unauthorised.

Delivery

We will send your kit as soon as reasonably possible after your order is accepted. Delivery times may vary depending on Royal Mail and are outside our direct control. If your kit does not arrive, we will normally send a replacement at our cost or offer a refund.

Your kit — important information

Kit scope: The scope of your results report depends on the product you have ordered. Our standard sperm test provides a full semen analysis. Our SnipCheck product is designed specifically for post-vasectomy confirmation and provides a different, more limited report appropriate to that purpose. Please ensure you have ordered the correct product for your needs.

SpermShield and kit validity: Your kit contains SpermShield, our proprietary semen preservation fluid. The SpermShield vial has an expiry date printed on its label — please check this before use. The SpermShield should be stored at room temperature; no refrigeration or freezing is required.

The SpermShield expiry date is not the same as the kit expiry date. The physical kit components (excluding SpermShield) remain valid for up to 3 years from manufacture. If your SpermShield has expired but your kit is otherwise intact, please contact us at hello@jackfertility.co.uk and we will send you a replacement SpermShield free of charge.

Please do not use an expired SpermShield — doing so may affect the preservation of your sample and the accuracy of your results.

Following the instructions: Please read and follow the Instructions for Use (IFU) provided with your kit carefully. Failure to do so may result in inaccurate or unprocessable results. We are not responsible for issues arising from failure to follow the IFU.

If your sample cannot be processed

On rare occasions, a semen sample may arrive at our lab in a condition that makes it impossible to process. This can occur due to insufficient sample volume, significant degradation in transit, or collection error.

If this happens, we will contact you and send you one free replacement kit so you can retest. Beyond this one free retest, we are unable to offer further replacements or refunds where the issue is related to sample quality or collection. This does not affect your rights where the issue is caused by a fault with the kit itself.

If the lab is unable to process your sample due to an equipment or lab fault on our side, we will always retest at our cost and this will not count against your one free retest entitlement.

Returns and refunds

Please see our Refund Policy for full details of your rights and our terms on returns, refunds, and replacements.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

Using our service responsibly

  • Only send samples that are genuinely yours and provided with your full consent.
  • Follow the Instructions for Use (IFU) provided with your kit carefully for accurate results.
  • Once received, samples are processed and destroyed typically within 2 days of arrival at our lab. They are not stored or used for any other purpose.
  • Keep your account details secure and notify us if you suspect unauthorised access.

Reporting concerns about kit performance

If you believe your kit has malfunctioned or given an unexpected result that may be due to a device fault (rather than user error or natural variation), please contact us at hello@jackfertility.co.uk. We take all performance concerns seriously. Where required, we report serious incidents involving our devices to the MHRA under our post-market surveillance obligations.

Your data and privacy

You always retain ownership of your personal data and health information. For full details of how we collect, use, and protect your data — including your health data — please see our Privacy Policy.

Intellectual property

  • All website content, branding, images, and materials belong to Jack Fertility Ltd.
  • You may use our website for personal, non-commercial purposes only.
  • You must not copy, scrape, reproduce, or distribute our content without permission.
  • Taking screenshots for your own records is fine.

If things go wrong

Our responsibility to you:

  • We provide our services with reasonable skill and care.
  • We do not exclude liability for death, personal injury, fraud, or any other rights you have by law, including your rights under the Consumer Rights Act 2015.
  • For all other claims, our liability is limited to the amount you paid for the specific kit or service.
  • We are not liable for indirect losses (e.g. lost income or business interruption).

What we cannot control:

  • Postal delays: Royal Mail and our courier partners occasionally experience disruption. We will always help with tracking and replacements where needed.
  • Lab equipment: Very rarely, machines need recalibration. If this affects your test, we will retest at our cost.
  • Natural variation: Results may differ from other semen analyses. That is normal biology.
  • External factors: Illness, medication, lifestyle, or stress can temporarily affect your results.

Disputes

If you are dissatisfied with our service, please contact us and we will try to resolve it quickly and fairly.

If we cannot resolve it informally, disputes will be governed by English law. The courts of England and Wales have jurisdiction over any dispute arising under these Terms. If you live in Scotland, you may also bring proceedings in the Scottish courts. If you live in Northern Ireland, you may also bring proceedings in the Northern Irish courts.

Service availability

We aim to provide reliable access but may occasionally need to suspend the service for maintenance or technical reasons. We will give reasonable notice where possible.

Legal

Force majeure: We are not responsible for failures caused by events outside our control (such as strikes, cyber-attacks, or supply chain disruptions).

Assignment: If Jack Fertility changes ownership, we may transfer our rights and obligations under these Terms. If this happens, we will notify you on our website.

Severability: If any part of these Terms is found invalid, the rest still applies.
