Hello, and welcome to Jack Fertility’s Terms of Service. We know this isn’t the most exciting read, but it’s important - these terms explain how our service works, what you can expect from us, and what we ask of you in return.

Our aim is to be clear, fair, and upfront. If something ever goes wrong, we’ll do our best to put it right.

Jack Fertility’s service is for people with sperm who want to learn more about their reproductive health. It is intended solely for wellness purposes, not for clinical diagnosis. Test results are provided for information only and should not replace advice from a healthcare professional. Due to natural variations in semen parameters, results from Jack Fertility may differ from semen analysis results you have received in the past, or may receive in the future.

Who can use Jack Fertility?

You must be 18 or older and legally able to consent to our services.
You must be based in the UK. We do not accept non-UK orders.
By ordering, you confirm the information and samples you provide are genuinely yours and given with your consent.

Your Account

Keeping it secure: If you create an account with us, you’re responsible for keeping your login details safe. Please let us know straight away if you suspect someone else has gained access without permission.
Updating details: You should keep your account details accurate and up to date so we can provide the best service.
Access and deletion: You can request a copy of the information linked to your account, or ask us to delete your account entirely, at any time, by contacting us at: privacy@jackfertility.co.uk . If you close your account, we’ll delete or anonymise your personal data unless we’re required to keep it for legal, regulatory, or safety reasons.
Our rights: We may suspend or close accounts if they are misused, if knowingly false or misleading information is provided, or if these Terms are breached. We’ll always act reasonably and, where possible, let you know the reason.

Using our website

You can use our website for personal, non-commercial purposes.
Don’t misuse it - that means no hacking, scraping, or interfering with how the site works.
The content we provide is for general information only. It does not replace medical advice.

Signing up for newsletters or promos

If you sign up for newsletters, promotions, or waitlists, you agree to receive the messages you’ve opted in to.
You can unsubscribe at any time using the link in our emails or by contacting us directly.

How do I place an order?

Orders are placed through our website.
Payment is taken at the time of order. We use secure third-party payment providers.
We may reject or cancel an order if:
- you are outside the UK
- payment cannot be processed
- we believe the order is fraudulent or unauthorised.

What about delivery?

We’ll send your kit as soon as reasonably possible after your order is accepted.
Delivery times may vary depending on Royal Mail and are outside our direct control.
If your kit doesn’t arrive, we’ll normally send a replacement at our cost or offer a refund.

How do returns and refunds work?

You have the right to change your mind within 14 days of delivery, provided the kit is unused and unopened.
Return postage is paid by us. We’ll provide you with a printable Royal Mail Tracked 24 returns label if you contact us to arrange a return. If you decide not to use our Tracked 24 returns label option and return the kit using your own postage method, we’ll refund the price you paid for the kit but will not cover any postage costs you incurred.
Refunds will be made to your original payment method once we receive and check the returned kit.
If your kit arrives to you damaged or is lost in the post, we’ll offer a refund or replacement.
Once a kit has been used or opened, we cannot accept returns for hygiene and safety reasons.

What we can’t control

We’re committed to providing a reliable service, but some things are outside our control:

👉 Postal delays: Royal Mail and our courier partners occasionally have bad days. We’ll always help with tracking and replacements where needed.
👉 Lab equipment: Very rarely, machines need recalibration. If this affects your test, we’ll always retest at our cost.
👉 Natural variation: Results may differ from other semen analyses. That’s normal biology.
👉 External factors: Illness, medication, lifestyle, or stress can temporarily affect your results.

Using our service responsibly

Only send samples that are genuinely yours and provided with your full consent.
Follow kit instructions carefully for accurate results.
Once received, samples are processed and destroyed typically within 2 days of arrival at our lab. They are not stored or used for any other purpose. You always retain ownership of your personal data and health information.
We rely on you to keep account details secure and to notify us if you suspect unauthorised access.
You can ask us to close your account at any time. When you do, we’ll follow the steps set out in our Privacy Policy to delete or anonymise your data, unless we’re required to keep it for legal, regulatory, or safety reasons.

Your data and privacy

You always retain ownership of your personal data and health information. For details on how we collect, use, and protect your personal data, including your health data, please see our Privacy Policy.

Who owns our content?

All website content, branding, images, and materials belong to Jack Fertility Ltd.
You may use our website for personal, non-commercial purposes only.
You must not copy, scrape, reproduce, or distribute our content without permission.
Taking screenshots for your own records is fine.

If things go wrong

Our responsibility to you:

We provide our services with reasonable skill and care.
We don’t exclude liability for death, personal injury, fraud, or any other rights you have by law.
For all other claims, our liability is limited to the amount you paid for the specific kit/service.
We are not liable for indirect losses (e.g. lost income, business interruption).

Disputes

If you are dissatisfied with our service, please contact us and we’ll try to resolve it quickly and fairly.
If we can’t resolve it, disputes will be handled under English law in the courts of England and Wales.

Service availability

We aim to provide reliable access but may occasionally need to suspend the service for maintenance, updates, or technical issues. We’ll give reasonable notice where possible.

Some final legal points

Force majeure: We are not responsible for failures caused by events outside our control (such as strikes, cyber-attacks, system failures, or supply chain disruptions).
Assignment: If Jack Fertility changes ownership (e.g. through merger or sale), we may transfer our rights and obligations under these Terms. If this happens, we’ll notify you on our website.
Severability: If any part of these Terms is found invalid, the rest still applies.
